Four University Administrative Policies Available for 21-Day, All-Campus Review and Comment Period

Pursuant to UAP 1100, Section 7, major revisions to four (4) existing policies in the University Administrative Policies and Procedures Manual are available for a 21-day, All-Campus Review and Comment period.

Draft UAP 1000: UNM History, Mission, and Organization  

     Summary of Proposed Revisions:
  • Provides updated, clearer, and more concise language, throughout.
  • Sharpens the institutional identity and aligns the policy with current branding and strategic messaging
  • Adds a Definitions section.
  • Adopts current policy formatting standards.
  • Adds a new section formally recognizing UNM’s Land, Labor, and Immigrant Acknowledgements.
The proposed revisions to UAP 2720 are primarily intended to improve clarity, organization, and alignment with existing federal and state civil-rights requirements governing the University’s response to discrimination
and related misconduct, and do not substantively alter individuals' reporting options, disciplinary standards, or the University’s overall approach to responding to reports of discrimination and related misconduct.
 
    Summary of Proposed Revisions:
  • Moves all prohibited discrimination, conduct, and protections related to sex (including sexual harassment, gender, gender identity, pregnancy and related conditions, sex, and sexual orientation) to UAP 2740, where revisions are being released concurrently with this policy.
  • Adds definitions for Protected Classes.
  • Updates reporting requirements for Responsible Employees to align with UAP 2740.
  • Aligns language with related University policies, including UAP 2740 and UAP 2745.

 

Draft UAP 2740: Sex Discrimination Including Sexual Harassment and Other Prohibited Conduct

The proposed revisions to UAP 2740 are primarily intended to improve clarity, organization, and alignment with existing federal and state civil-rights requirements governing the University’s response to sex discrimination and related misconduct, and do not substantively alter reporting options, disciplinary standards, or the University’s overall approach to responding to reports of sex discrimination and related misconduct.
 
    Summary of Proposed Revisions:
  • Clarifies distinctions between Title IX sexual harassment, other forms of sex-based misconduct addressed under Title VII and the New Mexico Human Rights Act, and Violence Against Women Act (VAWA) offenses addressed under the Clery Act, which may include conduct that is not sex-based;
  • Presents investigation, hearing, appeal, and informal resolution procedures (many of which were previously maintained in the CEEO Grievance Procedure) in a clearer and more structured format consistent with federal publication requirements;
  • Explains how the University responds to student sexual misconduct that may fall outside the jurisdictional definition of Title IX but still requires an institutional response under other applicable laws and University policy; and
  • Aligns language with related University policies, including UAP 2720 and UAP 2745.

 

Draft UAP 2745: Campus Crime and Fire Disclosures, Prevention Programs (Clery Act Compliance)  

     Summary of Proposed Revisions:
  • Adds a Definitions section to describe terms used throughout the policy.
  • Redistributes key aspects of Clery Act requirements throughout the policy.
  • Reframes the role of individual Campus Security Authorities (CSAs) so that the responsibilities reside in the portions of the policy specific to each process for collecting information for the annual disclosure of crime statistics.
  • Relocates federal definitions and disciplinary matters having to do with VAWA crimes (sexual assault, domestic violence, dating violence, and stalking) as prohibited conduct to UAP 2740.
  • Expands on prevention and awareness programs, specifically expanding on the four elements required in these programs: bystander intervention, risk reduction, procedures UNM will follow in response to reports of one of these crimes (pointing to UAP 2740), and New Mexico definitions of VAWA crimes. These state statutes are the only criminal definitions required in policy for the purposes of Clery compliance.
  • Introduces a Training section to specifically address which Campus Security Authorities (CSAs) are required to complete, and the trauma-informed training officials involved with disciplinary proceedings are required to complete annually.
  • Corrects and tailors language to be inclusive of UNM’s branch and separate campuses, written verbatim as the law requires in certain instances.
  • Relocates statements about emergency notification and timely warning (Lobo Alerts and Lobo Advisories, respectively) which used to reside in UAP 6130, into a section in 2745 on overall Ongoing Disclosures. The Clery Act mandates that the actual roles responsible for carrying out steps involved in issuing Clery messaging be identified and outlined in detail in this policy. The remainder of emergency response policy statements still reside in UAP 6130.
  • Introduces a section on General Crime Prevention, Safety, and Security Awareness Messaging to facilitate the release of information about criminal trends and reports received that fall outside the parameters of issuing an emergency notification or timely warning for Clery purposes.
  • Expands on fire reporting responsibilities, to include the daily fire log and Annual Fire Safety Report.
