Administrative Policies and Procedures Manual - Policy 3635: Unemployment Compensation

Date Originally Issued: 06-30-1982
Revised: 07-01-1994, 06-08-2023

Process Owner: Vice President for Human Resources

1. General

The University extends unemployment coverage to non-student employees in accordance with the state and federal regulations. This coverage is designed to provide benefit payments for a short period to workers who through no fault of their own are unable to obtain gainful employment. The University pays the full cost of the coverage.

2. Eligibility

2.1 Employees Working in New Mexico

New Mexico laws and regulations and the New Mexico Department of Workforce Solutions (Unemployment Insurance Program) determine which individuals are eligible for unemployment insurance benefits based on the circumstances of the separation.  If an individual feels they qualify for benefits, the individual is responsible for filing a claim with the New Mexico Department of Workforce Solutions (Unemployment Insurance Program).  For more information about New Mexico unemployment benefits visit https://www.dol.gov/general/topic/unemployment-insurance.

2.2 Employees Living and Working Remotely Out-of-State

Any employee who has been approved for out-of-state remote work may be subject to the state unemployment laws for the state in which the employee works.  Generally, a current or former out-of-state remote employee is responsible for filing a claim for benefits with the state where that individual worked.  If the individual worked in a state other than the one where the individual now lives or if the individual worked in multiple states, the state unemployment insurance agency where the individual now lives can provide information about how the individual may file a claim with other states. For information about the unemployment insurance program in a particular state and how to file a claim there see the Unemployment Benefits Finder at https://www.dol.gov/general/topic/unemployment-insurance.

3. Departmental Responsibility

If a department receives any documentation from the New Mexico Department of Workforce Solutions (Unemployment Insurance Program) or any other state unemployment insurance agency, it should immediately forward the documentation to the Division of Human Resources.
